1. Acceptance of Terms

By accessing or using the StayHuddle platform (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree to all of these terms, please do not use our Service. StayHuddle reserves the right to update or modify these terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of those changes.

These terms apply to all visitors, users, and others who access or use the Service. By using StayHuddle you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Booking Terms

When you make a booking through StayHuddle, you are entering into a direct contractual relationship with the hotel or accommodation provider. StayHuddle acts as an intermediary to facilitate bookings and is not a party to the accommodation contract between you and the provider.

All bookings are subject to availability and confirmation by the accommodation provider. You are responsible for ensuring that all details provided during the booking process are accurate, including guest names, dates, and room requirements. StayHuddle is not liable for errors resulting from inaccurate information provided by the user.

Family room configurations (number of adults and children) must be accurately declared at the time of booking. Misrepresentation of guest numbers may result in additional charges or denial of accommodation.

3. Payment Terms

StayHuddle processes payments securely via PayPal and Square. By providing payment information, you represent and warrant that you are authorised to use the designated payment method and that your payment information is accurate and complete.

Prices displayed on the platform are quoted in Australian Dollars (AUD) unless otherwise specified. All prices include applicable taxes where stated. StayHuddle reserves the right to correct any pricing errors discovered after a booking has been placed.

Payment is processed at the time of booking confirmation unless alternative arrangements have been specified. You will receive an email confirmation of your payment and booking details.

4. Cancellation Policy

Cancellation policies vary by accommodation provider and are displayed at the time of booking. You are responsible for reviewing and understanding the cancellation policy applicable to your booking before completing your reservation.

StayHuddle will facilitate cancellation requests in accordance with the policy of the relevant accommodation provider. Refunds, where applicable, will be processed within 5–10 business days and credited to your original payment method.

Non-refundable bookings are clearly marked at the time of booking. In exceptional circumstances, StayHuddle may, at its sole discretion, assist in negotiating refunds with accommodation providers, but cannot guarantee outcomes.

5. Limitation of Liability

To the maximum extent permitted by applicable law, StayHuddle and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the Service.

StayHuddle does not guarantee the accuracy, completeness, or reliability of any content provided by third-party accommodation providers, including but not limited to hotel descriptions, photographs, availability, and pricing. StayHuddle shall not be responsible for any discrepancies between the listed information and the actual accommodation.

Our total liability to you for any claim arising out of or relating to these terms or your use of the Service shall not exceed the amount paid by you for the specific booking that gave rise to the claim.

6. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and be enforceable.

StayHuddle's failure to enforce any right or provision of these terms shall not be considered a waiver of those rights.
